Terms of Service

These Terms of Service ("Terms") govern your use of the Forgd Fitness mobile application ("Forgd", "the app"). By downloading, installing, or using Forgd, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use Forgd. If you are between 13 and 18, you must have a parent or legal guardian's permission. By using the app you represent that you meet these requirements.

2. Your Apple ID and Account

Forgd uses Sign in with Apple as its only sign-in method. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. Notify Apple immediately if you believe your Apple ID has been compromised.

3. Subscriptions

Forgd offers auto-renewable subscriptions through Apple's App Store:

  • Forgd Premium (Monthly) — $9.99 USD per month
  • Forgd Premium (Annual) — $59.99 USD per year

Prices shown in the app are displayed in your local currency as determined by the App Store. Prices may vary by region.

3.1 Billing

Payment will be charged to your Apple ID account at the confirmation of purchase. Your subscription automatically renews for the same billing period at the same price unless cancelled at least 24 hours before the current period ends. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

3.2 Free trial

New subscribers receive a 7-day free trial when they start a Forgd Premium subscription. You will not be charged during the trial. Your subscription begins, and your Apple ID is charged the applicable subscription price, at the end of the 7-day trial period unless you cancel at least 24 hours before the trial ends.

You can cancel at any time during the trial from Settings → your Apple ID → Subscriptions, or via Profile → Subscription → Manage Subscription inside Forgd. Any unused portion of the trial is forfeited if you upgrade to a paid subscription early. The free trial is available only to new subscribers and cannot be combined with other introductory offers.

3.3 Managing and cancelling

You can manage your subscription and turn off auto-renewal at any time from your device's Settings → your Apple ID → Subscriptions, or via the Manage Subscription link inside Forgd. Cancellation takes effect at the end of the current billing period; you retain access until that period ends.

3.4 Refunds

Refunds are handled by Apple according to Apple's refund policy. Forgd cannot issue refunds directly. You may request a refund from Apple by submitting a request at reportaproblem.apple.com.

3.5 Price changes

We may change subscription prices. If a price change affects your ongoing subscription, Apple will notify you and require your consent before charging the new price.

4. What Premium Includes

Forgd Premium unlocks all 11 training modalities, unlimited workout programs and templates, full nutrition features including barcode scanning and restaurant menu lookups, community groups and leaderboards, progress photo history, advanced Apple Health integration, badges and achievements, and the ability to request a trainer through the in-app trainer directory. The specific features included in Premium may change over time.

5. License and Acceptable Use

Subject to your compliance with these Terms, we grant you a personal, non-transferable, revocable, non-exclusive license to install and use Forgd on Apple devices you own or control, solely for your personal, non-commercial use.

You may not:

  • Copy, decompile, reverse-engineer, or attempt to extract the source code except as allowed by law
  • Bypass, disable, or circumvent any paywall, entitlement check, or security mechanism
  • Use the app to harass, abuse, threaten, or otherwise violate the rights of others
  • Upload or transmit content that is unlawful, infringing, obscene, or otherwise objectionable
  • Use the app in a way that could interfere with or damage the app or any connected services
  • Sell, sublicense, rent, or redistribute the app or any of its content

6. User-Generated Content

You retain all rights to the content you create in the app — your workout plans, notes, progress photos, messages, and custom exercises. By using the app's community or sharing features, you grant Forgd a limited, non-exclusive license to display the content you choose to share, only for the purpose of operating those features.

You are solely responsible for the content you post. You represent that you have the rights to post it and that it does not violate any law or any third party's rights.

7. Fitness and Health Disclaimer

Forgd is not a medical device. The information, calculations, training programs, and nutrition plans provided by the app are for informational and educational purposes only, and are not intended as medical advice, diagnosis, or treatment.

Consult a qualified healthcare professional before starting any new exercise regimen, changing your diet, or if you have any pre-existing medical condition. Stop exercising and seek medical attention if you experience pain, dizziness, or other symptoms.

You assume all risks associated with physical activity you undertake based on app content. Forgd does not replace personalized professional advice.

8. HealthKit and Health Data

If you grant HealthKit access, Forgd reads and writes data to your personal Health store on your device per Apple's HealthKit policies. We do not sell, share for advertising, or otherwise disclose HealthKit data. See our Privacy Policy for details.

9. Intellectual Property

The app, including its design, code, artwork, and the programmed workout and nutrition content we provide, is owned by Bryce Harr and protected by copyright, trademark, and other applicable laws. No rights are granted to you beyond the license in Section 5.

10. Termination

You may stop using Forgd at any time. You may delete your account and all associated data from Profile → Account → Delete Account, at which point your license under these Terms ends.

We may suspend or terminate your access to the app if you materially violate these Terms, if required by law, or if we discontinue the app. If we discontinue the app, you may be entitled to a pro-rated refund per Apple's policies.

11. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure, or that defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, Forgd and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the app.

Our total aggregate liability for any claim arising out of or related to these Terms or the app will not exceed the amount you paid us for the app during the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in those jurisdictions, the above exclusions and limitations apply only to the extent permitted.

13. Indemnification

You agree to indemnify and hold harmless Forgd and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the app, your content, or your violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in California for the resolution of any dispute arising out of these Terms, except where such an agreement is prohibited by local law.

Nothing in this section limits any statutory rights you may have as a consumer.

15. Apple Terms

The following terms apply if you obtained the app from the Apple App Store:

  • These Terms are between you and Bryce Harr only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. Apple has no other warranty obligation with respect to the app.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a user.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the latest change. Continued use of the app after a material change constitutes acceptance of the updated Terms.
